THIS IS A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS

BY SIGNING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

1. SCOPE OF SERVICES

I understand that Olakino Wellness & Beyond offers wellness, recovery, fitness, and aesthetic services including, but not limited to:

• Whole Body Cryotherapy

• Cryo Slimming, Cryo Toning, Cryo Facials

• Infrared Sauna / Heat Exposure

• Pulse PEMF Therapy

• Rapid Reboot Compression Therapy

• Medical-Grade Red Light Therapy Beds

• Zero Gravity Massage Chairs

• Optimum Foot Detox Systems

• Endospheres Therapy (Cellulite Reduction)

• Barre & Pilates & Fitness Classes

• General Wellness & Recovery Services

2. ASSUMPTION OF RISK (ALL SERVICES)

I understand that participation in these services involves inherent risks, including but not limited to:

• Injury, burns, frostbite, or adverse skin reactions

• Cardiovascular stress or changes in blood pressure

• Dizziness, fainting, or loss of consciousness

• Nerve stimulation or discomfort

• Equipment-related risks

• Aggravation of existing conditions

• Risk of serious injury, illness, or death

I FULLY AND EXPRESSLY ASSUME ALL RISKS, known and unknown, foreseeable and unforeseeable.

3. MEDICAL ACKNOWLEDGMENT

I acknowledge:

• I am voluntarily participating

• I have disclosed all medical conditions

• I understand services are not medical treatment

• I will consult a physician if needed

I understand certain services may not be appropriate if I have conditions including (but not limited to):

• Pregnancy

• Cardiovascular conditions

• Pacemakers or implanted devices

• Circulatory disorders

• Neurological conditions

• Skin conditions or sensitivities

• Recent surgeries or injuries

 

4. SERVICE-SPECIFIC RISK DISCLOSURES

A. CRYOTHERAPY / CRYO SERVICES

• Exposure to extreme cold temperatures

• Risk of frostbite, burns, dizziness

B. INFRARED SAUNA / HEAT

• Risk of dehydration, overheating, heat stroke

C. PEMF THERAPY

• Electromagnetic exposure risks

• Interference with implanted devices

D. COMPRESSION THERAPY

• Circulatory pressure risks

• Discomfort or improper use complications

E. RED LIGHT THERAPY

• Eye sensitivity if protection not used

• Skin sensitivity reactions

F. MASSAGE CHAIRS

• Muscle soreness or aggravation of injuries

G. FOOT DETOX

• Skin irritation or sensitivity

H. BARRE / PILATES / FITNESS

• Musculoskeletal injury

• Strain, sprain, or falls

I. ENDOSPHERES / BODY TREATMENTS

• Bruising, soreness, lymphatic response

5. SAFETY COMPLIANCE

I agree to:

• Follow all instructions

• Use equipment properly

• Report discomfort immediately

• Disclose changes in health

• Not exceed recommended session limits

6. RELEASE OF LIABILITY (EXPRESS NEGLIGENCE CLAUSE — TEXAS LAW)

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS OLAKINO

WELLNESS & BEYOND, MKU INC, AND ALL OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS FROM

ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO ANY INJURY, DAMAGE,

OR LOSS, INCLUDING DEATH, THAT MAY RESULT FROM MY PARTICIPATION IN ANY SERVICES OFFERED.

THIS RELEASE EXPRESSLY INCLUDES ANY CLAIMS ARISING FROM THE NEGLIGENCE OF OLAKINO WELLNESS & BEYOND OR ITS

REPRESENTATIVES.

7. NO WAIVER OF GROSS NEGLIGENCE

This agreement does NOT waive liability for gross negligence, reckless conduct, or intentional misconduct under Texas law.

8. INDEMNIFICATION

I agree to indemnify and hold harmless Olakino from any third-party claims resulting from my participation.

​

9. PHOTO / MEDIA CONSENT

I consent to photo/video use

​

10. GOVERNING LAW

This agreement is governed by the laws of the State of Texas.

​

11. SEVERABILITY

If any provision is invalid, the remainder remains enforceable.

​

12. ANNUAL RENEWAL & CONTINUING AGREEMENT

This agreement applies to all current and future visits and remains valid unless revoked in writing.

13. ACKNOWLEDGMENT OF UNDERSTANDING

I certify:

• I have read and understand this agreement

• I understand I am waiving legal rights

• I sign voluntarily
